EXCELLENT ADVENTURES, INC. (EAI) agrees to provide the services specified in the accompanying website subject to the terms, conditions and limitations contained in this agreement.

To participate on the trip every participant must complete an application in full, sign it, and make all payments on time. EAI acts only as an agent for passengers in arranging transportation and accommodations. Air/Bus carriers, Hotels, Condos, Property Management Companies, Ski Shops and Ski Resort Personnel are not agents or employees of EAI, but are independent contractors over whom we have no direct control. Except for negligence on our part, EAI shall not be liable for any claims, losses, damages, cost or expenses arising out of, but not limited to (a) pandemic, sickness, injury, accident, or death, (b) damage, loss, delay or theft of baggage or other property, (c) inconvenience or loss of enjoyment (d) injury to property or person, (e) weather, (f) motorcoach or flight delays, changes in the itinerary or schedule, canceled
 or missed air connections, (g) any factors or causes beyond our control. Our liability should in no case be greater than a full refund for the amount paid.

COVID-19 ADDENDUMIf the resort closes or your trip is canceled due to COVID-19 and/or related restrictions or if you get COVID-19 and can provide a positive test result, then you will be refunded everything except your $100 deposit. The $100 deposit will remain attached to your name and can be used as a credit towards a future UBSki trip, the credit expires at the close of the resort for the next ski season.

VERIFICATION OF DEPARTURE TIMES IS YOUR RESPONSIBILITY. All departure times are subject to change without notice, and do not imply any guarantee of arrival or departure times.

FLIGHT INFORMATION - Airline restrictions are those of the airlines and you are responsible for these restrictions. You must inform EAI if you have not received your airline flight information within 10 days prior to departure. EAI cannot be responsible if it has not been notified by the given time. With connecting flights, allow 
enough time for delays or schedule changes. We do not recommend you purchase non-changeable or non-refundable connecting tickets.

BUS INFORMATION - You must inform EAI if you have not received your bus departure information within 10 days prior to departure. EAI cannot be responsible if it has not been notified by the given time. EAI has the authority to cancel any bus that does not fill to the maximum occupancy. In this case, EAI will notify participants and refund in full for your bus travel only. EAI does not take responsibility for lost, stolen, damaged luggage or personal belongings. Cancellations from the bus are non-refundable unless a substitute is 
found. Any damage resulting from the passengers of the bus will be the responsibility of all passengers on that bus.

PRICES - Prices are subject to change until paid in full. Trip price will vary with respect to how many people are occupying a room. To obtain a certain price, it is your responsibility to have the necessary number of participants staying in your room. If one of the participants cancels, their roommate's trip prices will vary. No refund or trip tickets will be given out until these differences have been paid. Trip price includes no meals or other incidentals. A $30 late sign up fee will be added for reservations made after October 20, 2023/ February 6, 2024. All Airfare, Airport Transfer and Motor Coach Transportation Customers are subject to fuel surcharge fees.

LODGING - EAI reserves the right to change accommodations without notice up to the day of arrival due to unexpected emergencies or sale of property. An attempt will be made to provide equal accommodations or upgrade at no charge to you. Amenities in units may vary, EAI does not guarantee that all amenities are available in all units. Such as, but not limited to, WIFI, Fireplaces, Cable TV, Stereo, VCR & DVD players, Washer & Dryers, hot tubs and balconies.

INSURANCE - We recommend you purchase baggage, health and accident insurance. Travel Insurance offered by EAI covers land portion of the trip only.

DAMAGE DEPOSIT - A $25 per person damage deposit is due at final payment. The total deposit will be refunded within 90 days after departure provided there is no excessive damage or cleaning to your room, public areas, bus, or areas responsible by the UBSki group. An additional security deposit may be collected, in the form of a credit card or cash, by the management company at the time of check-in. The security deposit will be refunded provided there is no damage or excess cleaning to the unit. Please pay all phone bills before departure. Within 1 hour of check-in to your room, the occupants of the unit must report any damage or maintenance problems to the hotel/condo management to ensure a deposit refund. Before checking out it is your responsibility to pay all room damages. If you can not pick up your deposit in person, send a stamped, self-addressed envelope to UBSki.

ROOM CHECK-IN AND CHECK-OUT are 4 pm and 10 am respectively.

PAYMENTS - Full payment is due for Winter Break on November 15, 2023 and for Spring Break on February 13, 2024. For each week the payment is late there will be an additional $10 late charge. Reservations not paid in full within 30 days of departure will not be guaranteed. Returned check fee is $30.

CHANGES - Substitution of a participant is prohibited and does not release you from the cancellation fees. If you or one of your roommates cancels, the trip price that the roommates still on the trip will have to pay will vary. We hold both the person canceling and their roommates responsible for these differences. We will be unable to give out any refund or trip tickets until these differences have been paid. Schedule changes by the customer will cause a $25 additional fee. There will be no changes of any kind 14 days or less before departure. EAI has the right to use similar accommodations and services if the original accommodations and services become unavailable for any reason. Cancellation fees do not apply to Travel Insurance Customers.

REFUNDS - “No Shows” will not receive any refund. No refunds will be given for any and all unused portions of the trip including transportation, accommodations, activities, unused lift tickets, rental vouchers, or optional items. In the result of illness or injury requiring medical attention a partial refund will be given for unused lift tickets and ski or snowboard rentals. EAI must receive a written physician’s statement of the illness or injury within 30 days of the trip for a partial refund to be given.

WEB & PRINTED ADS - All prices and/or descriptions are subject to change. Although every precaution is taken, errors in prices and/or descriptions do occur on our web site and in printing. We reserve the right to correct any such error.

EAI reserves the right to use any picture or video of the tour participants and activities for our advertising.

Verbal modifications to this agreement are not valid. EAI may refuse to accept or retain you as a participant at any time whenever in our sole judgment, conditions warrant, in which case no refund will be made.
